PUBLIC NOTICE

APPLICATION TO MODIFY HAZARDOUS WASTE PERMIT

VELSICOL CHEMICAL LLC, CHATTANOOGA FACILITY

PLEASE TAKE NOTICE that Velsicol Chemical LLC (Velsicol), 4902 Central Avenue, Chattanooga, Tennessee 37410, as the holder of Hazardous Waste Permit No. TNHW-105, has submitted an Application to the Tennessee Department of Environment and Conservation (TDEC) seeking a Class 3 Modification to that Permit. The modification will establish requirements for remediation of environmental contamination at the Facility in Chattanooga, Tennessee. The proposed Final Remedy addresses all Solid Waste Management Units and includes the installation of a vegetated soil cover barrier and continuation of groundwater recovery and monitoring operations. The Application also includes updates to Part A of the Permit.

During the sixty (60) day public comment period following the publication of this notice, beginning January 16 and ending March 17, 2009, any interested party may submit written comments on the requested permit modification. Persons wishing to comment are invited to submit comments in writing to TDEC, Attn: Roger Donovan, L&C Tower, 401 Church Street, Nashville, Tennessee 37243, telephone: (615) 532-0864.

A public meeting will be held at 7:00 p.m. on Tuesday, February 17, 2009 at the Bethlehem Community Center at the address noted below. Information on the proposed modifications will be presented and opportunities for asking questions and submitting comments to Velsicol and TDEC will be provided at this meeting.

I hope everyone sent a petition in voicing grave concern for the health of anyone exposed to his area, or the groundwater (maybe even in your area). It sounds like the city plans to just put a layer of dirt over this 40-plus years of pesticide production pollution, and call it a night. Then they can put a school, park or playground there to be cleaned up at taxpayers expense, while the company skips off cleanly to another town under the guise of bankruptcy, and pollutes some other town that may cover up the embarrassing crime and health issues as well. After all, this treatment of our city does not come off as very "green."
